These Terms and Conditions (“Terms”) apply to your purchase of any Firepower Sessions package (“Sessions”) offered by Taliah Kate Byron trading as Badass Beings (“we,” “us,” or “our”). By completing your purchase, you (“you” or “Client”) agree to be bound by these Terms.

1. SESSION PACKAGES & DELIVERY
Sessions are delivered 1:1 via virtual call and are each up to 55 minutes in length.

You may book a maximum of one session per week, regardless of package size.

Your package is valid for 12 months from the purchase date. Unused sessions will expire at the end of that period and are non-refundable.

2. CANCELLATION & RESCHEDULING POLICY
You may reschedule a session with at least 24 hours’ notice via the booking link provided.

If you cancel with less than 24 hours’ notice, or fail to attend the session, the session will be forfeited and not refunded or rebooked.

If we need to reschedule, we’ll provide as much notice as reasonably possible.

3. REFUNDS & CHANGE OF MIND
All purchases are final and non-refundable, including if you change your mind, fail to use the sessions, or no longer require the service.

This policy complies with your rights under the Australian Consumer Law (ACL). You are entitled to a remedy only in cases of a major fault or failure as defined by the ACL.

4. PAYMENT TERMS
All prices are listed in Australian Dollars (AUD) and include GST where applicable.

For payment plans (if agreed privately), the full agreed amount is owed and must be paid according to the plan schedule.

Failure to make timely payments may result in loss of access to sessions, cancellation of your plan, or fee recovery proceedings.

5. INTELLECTUAL PROPERTY
All materials, frameworks, methods, and insights shared during sessions (including the Sought After Method™ and The Precision Brief™) are owned by Badass Beings.

You are granted a personal, non-transferable license to use these materials for your own business development. You may not copy, distribute, resell, or reproduce the materials in any way.

6. CLIENT CONDUCT & ELIGIBILITY
By purchasing, you confirm that:
You have the systems in place to implement strategic guidance.

You take full ownership of your outcomes and are not purchasing for general or introductory coaching.

You agree to engage respectfully, responsibly, and professionally throughout your sessions.

We reserve the right to cancel or refuse sessions for conduct that is abusive, inappropriate, or not in alignment with the intended use of this service.

7. SESSION PREPARATION & CLIENT RESPONSIBILITY
Each Firepower Session runs for up to 55 minutes. If your session objective is achieved earlier, we may wrap before the full duration. This allows us to stay focused on high-leverage moves without forcing filler.

To support the most effective use of time, you agree to complete The Precision Brief at least 24 hours prior to each booked session.

This pre-session form helps identify your priority, streamline the call, and accelerate decision-making.

If The Precision Brief is not completed in time, the session may be used for general exploration or rescheduled at the discretion of the Service Provider.

You acknowledge that incomplete or vague input may impact the clarity, direction, or value of the session.

8. LIMITATION OF LIABILITY
To the extent permitted by law:
We do not guarantee specific outcomes or business results.

Our liability is limited to the resupply of services or a refund for services not delivered.

We are not liable for indirect, incidental, or consequential damages.

9. BLACKOUT PERIODS
We may observe scheduled breaks (e.g., end-of-year shutdowns). These will be communicated with reasonable notice and do not extend the 12-month session expiry.

10. DISPUTE RESOLUTION
If a dispute arises, you agree to notify us in writing and attempt to resolve the issue in good faith before pursuing external remedies.

11. GOVERNING LAW
These Terms are governed by the laws of Queensland, Australia. By purchasing, you submit to the exclusive jurisdiction of the courts in Queensland for any dispute arising out of these Terms.

13. NO GUARANTEE OR RELIANCE
You understand that business results depend on many factors, including your own implementation, decision-making, and external circumstances.

While strategic support is provided, we do not guarantee specific outcomes. Nothing shared during sessions, on our website, or in materials should be considered financial, legal, or professional advice.
You agree not to rely on any such information as a guarantee of results.

14. SERVICE INTERRUPTIONS (FORCE MAJEURE)
We may temporarily pause delivery of sessions in the event of illness, personal emergency, or circumstances beyond our control (e.g. power outages, natural disasters, tech failure).

In such cases, you will be notified, and sessions will resume as soon as reasonably possible. No refund or credit will be provided during such interruptions, provided they do not exceed 30 calendar days.

15. TESTIMONIAL USE (WITH CONSENT)
We love celebrating your wins. You grant us permission to use your name and any written or verbal testimonial (e.g. from emails, forms, or messages) for marketing or promotional purposes only after receiving your explicit approval.

You may withdraw this permission at any time by emailing tk@badassbeings.com.

16. SEVERABILITY
If any provision of these Terms is held to be invalid, illegal or unenforceable for any reason, that provision will be severed, and the remaining provisions shall continue in full force and effect.

17. SURVIVAL
The obligations in the following clauses will survive the expiry or termination of this agreement:
Intellectual Property, Limitation of Liability, Dispute Resolution, Testimonial Use, Governing Law, No Guarantee or Reliance, and any others which by their nature should reasonably survive.

18. INTERPRETATION
In these Terms, unless the context requires otherwise:
Words in the singular include the plural and vice versa.

Headings are for convenience and do not affect interpretation.

“We,” “our,” and “us” refers to Badass Beings / Taliah Kate Byron.

“You” or “Client” refers to the person purchasing or attending the Firepower Sessions.

References to a "session" means a 55-minute 1:1 strategic call.

“Precision Brief” means the pre-session intake form provided to clients at least 48 hours before their session.
